General Terms of Sale

1. Definitions

1.1 “Buyer” means the individual or company purchasing products from the Seller

1.2 “Seller” means ITS Doozie Limited (company registration, 15587940, England, United Kingdom). ITS Doozie Limited is a trading    name of ITSM Assist Limited (company registration, 07618216, England United Kingdom). Address, Swaby's Yard, Walkergate, Beverley. HU17 9BZ. England

1.3 “itsD Shop” means the place where products are advertised for sale

1.4 “itsD Authors” refers to the place where products are organised into Groups. Members can subscribe to one or more Groups, allowing them access to the products within those Groups during the subscription period ) Pricing Plan.

1.5 "Member" means a Buyer who subscribes to one or more Groups within itsD Authors.

1.6 “Pricing Plan” refers to an agreement between the Seller and the Buyer that outlines a structured payment schedule. The price and schedule, including terms of validity or automatic renewal, will be  specified within the Pricing Plan.

 

2. Agreement

2.1 These Terms and Condition of Sale (“Terms”) apply to all sale of products by the “Seller” to the “Buyer” and shall prevail over any conflicting terms by the “Buyer”, unless expressly agreed by the “Seller”.

 

3 Price and Payment

3.1 The price for the products will be stated in the “itsD Shop”, or in “itsD Authors”

3.2 Payment for products purchased in the “itsD Shop” will be made at source.

3.3 Payment for products purchased in “itsD Authors”” will be made via a "Pricing Plan".

3.4 If a "Pricing Plan" automatically renews, "Members" can cancel their "Pricing Plan" at any time when the next billing cycle will not automatically renew. Meanwhile, "Members" can access products, including any new products added to the group, until the next billing cycle.

4. Liability

4.1 The “Sellers” total liability for any loss or damage arising out of the with the sale of products shall be limited to the price of the sale of products.

4.2 The “Seller” shall not be liable for any indirect, special, or consequential damages, including loss of profits.

 

5. Refunds

5.1 Requests for refunds should be submitted via email to admin@itsdoozie.co.uk "its Doozie" will review the circumstances and supporting evidence of each request, reserving the right to either honour or refuse such requests.

 

6. Copyright

6.1 All products and services which are either under direct Copyright of "its Doozie" or licensed to "its Doozie" by its suppliers, the subscriber may not copy, reproduce, distribute, or transmit any part of the products and services for commercial gain without the prior consent of "its Doozie". All complaints concerning products or content posted by our Members should be submitted to admin@itsmassist.co.uk, along with the name and contact details of the person authorised to act on behalf of the owner of the copyright interest;

 

7. Property of Law

7.1 This Agreement/Contract shall be construed and governed in all respects by English Law and, unless otherwise stated in writing,  such products or services shall not be required to comply with any provisions of any other law. All disputes arising under or relating to this Agreement/Contract shall be subject to the jurisdiction of the Courts of England.
